By entering in a contractual relationship with Holistic Horse Training (“HHT”) and/or Makortoff’s Paradise Farm (“the Farm”) and Pascale Makortoff-Kull and/or Michael Makortoff as owners and instructors (“the Instructor”) you give up your right to sue. A contractual relationship is established by:

• Paying (including prepaying) for online or offline lessons, coaching, clinics, courses or any other activity or
• At arrival at the Farm or
• When beginning to prepare for a lesson, clinic or other activity related to HHT, the Farm or the Instructor at any other place.

Activities on the Farm and its environment, working with horses or riding and any interaction with horses, farm animals, pets or wildlife are potentially dangerous and there is a risk of severe or fatal injury.

Obvious and foreseeable risks, dangers, and hazards:

• Accidents while hiking, biking or riding
• Falling off a horse
• Accidents during predictable and/or unpredictable actions and/or reactions of any animal (pets, horses, farm animals, wildlife) at any time
• Accidents while swimming, boating or playing in the lakes or creeks
• Accidents during any activity or stay at the Farm and its environment

For students of Holistic Horse Training (lessons, coaching, clinics and courses on-/offline and in person):

• Accidents with the student’s horse or any horse the student owns, leases or works with (including horses owned by the Farm or the Instructor) (“his Horse”) can happen before, while and after taking part in an activity and have the risk of being severe or fatal.
• The student rides or works with his Horse at his/her own risk and releases also the premise’s owner of his/her liability during the use of the premise (including by negligence).
• There is no guarantee for success in solving the issues/problems/challenges of the student and his Horse, nor for success in achieving certain goals.
• The student is responsible for any damage to and of his Horse.
• It is highly suggested to become a member of a provincial Riding Association (HCBC for British Columbia) which includes personal liability insurance in the event his Horse causes property damage or bodily injury to a third party.

This Release of Liability, Waiver of Claims, Assumption of Risk and Indemnity Agreement also exempts the Farm and the Instructor from liability caused by negligence.

This Release of Liability, Waiver of Claims, Assumption of Risk and Indemnity Agreement is accepted without signatures at the moment of

• Paying (including prepaying) for online or offline lessons, coaching, clinics and/or courses or
• At arrival at the Farm or
• When beginning to prepare for an activity related to HHT, the Farm or the Instructor at any other place

and is valid for subsequent activities without explicit explanations.
